Terms of use

Conditions governing use of the Dropium platform, both by the companies that contract it and by the staff who operate it.

1. Purpose and scope

These terms govern access to and use of the Dropium platform, owned by SOFTGENIO, S.L., comprising the web control centre and the associated mobile applications.

Dropium is a professional tool. It is not aimed at the general public, offers no online sales to consumers and processes no payment data.

2. Accounts and access

  • Accounts are created by the logistics operator contracting the service; there is no open sign-up.
  • Each account corresponds to an identified person and credentials are personal and non-transferable.
  • The operator is responsible for keeping staff permissions up to date and for removing access from those who no longer need it.

3. Obligations of staff operating the application

Anyone accessing the application processes third-party data — the recipients of shipments — on behalf of the shipper. These obligations give effect to the instructions under Article 29 GDPR and the duty of confidentiality under Article 28(3)(b).

  • Maintain confidentiality over all recipient data accessed, both during and after the relationship.
  • Use it exclusively to carry out the assigned delivery or pickup.
  • Do not contact the recipient for reasons unrelated to the shipment.
  • Do not keep their data by your own means: not in your phone contacts, not in personal photographs, not in notes.
  • Do not photograph the recipient or share their information through any channel.
  • The proof photo documents the parcel at the delivery point, not the people present.
  • Do not share credentials, including on shared terminals: each operator signs in and out under their own account.
  • Immediately report to your manager any loss of the device or suspicion of unauthorised access.

Accepting these conditions does not legitimise any data processing and does not replace the privacy information, which is provided separately and can be read without accepting anything. Its purpose is to evidence that instructions have been received and a duty of confidentiality assumed.

4. Acceptable use

  • Attempting to access data or functions outside assigned permissions is not permitted.
  • Bulk extraction of platform data by means other than the export functions provided is not permitted.
  • Interfering with the operation of the service or with the integrity of operational records is not permitted.
  • Using the platform for purposes other than the contracted logistics operation is not permitted.

5. Availability and continuity

The field applications are designed to keep working offline and to sync when the network returns. Even so, the service may be interrupted by planned maintenance, which is announced in advance, or by infrastructure provider incidents.

6. Intellectual property

The platform, its code, its interface, its graphic elements and its documentation are the property of SOFTGENIO, S.L.. Reproduction, representation, modification or adaptation, in whole or in part, without prior written authorisation is prohibited.

Operational data entered by the client remains theirs. On termination of the contract it is returned or deleted, as instructed.

7. Data processing

In respect of recipient data, SOFTGENIO acts as processor and the conditions are governed by the data processing agreement entered into with each shipper client under Article 28 GDPR. In respect of user staff data, it acts as controller and the privacy policy applies.

8. Applicable law

These terms are governed by Spanish law. Users resident in another European Union member state retain the benefit of the mandatory provisions of their national law.
